Last updated: [27/10/2025]
Welcome to Marta’s Kitchen! The terms “we”, “us”, and “our” refer to Marta’s Kitchen (“Marta’s Kitchen”, “MK”, or “the Company”).
These Terms and Conditions (“Terms”) govern your use of our website [martaskitchen.co.uk] and all related products, services, and communications (collectively, the “Services”).
By placing an order or using our Services, you agree to be bound by these Terms and our Privacy Policy [LINK].
If you do not agree, please refrain from using the Services.
SECTION 1 – ABOUT US
Marta’s Kitchen is a UK-based catering business providing freshly prepared food made to order.
We operate via our online store, custom menu orders, and direct communication with clients.
We are not a restaurant or takeaway service; all dishes are made to order from a curated and seasonal menu.
SECTION 2 – MENU AND CUSTOM ORDERS
-
Marta’s Kitchen offers a set seasonal menu.
Any custom requests, substitutions, or ingredient changes are subject to prior written approval and may incur additional costs or be declined at our discretion.
-
We reserve the right to refuse or cancel off-menu requests or customisations that are not feasible within our production schedule.
-
Dishes and portion sizes are prepared as described on our website or in your confirmed order summary; presentation and garnish may vary depending on ingredient availability and seasonality.
-
Prices and menus are subject to change without notice.
SECTION 3 – ALLERGIES AND DIETARY REQUIREMENTS
We take food safety seriously, but we cannot guarantee an allergen-free environment.
Our kitchen handles all major allergens including nuts, sesame, gluten, eggs, dairy, mustard, and soy.
-
It is your responsibility to inform us in writing of any allergies or intolerances before placing an order.
-
While every effort is made to avoid cross-contamination, all food is prepared in the same kitchen.
-
By placing an order, you acknowledge and accept that Marta’s Kitchen cannot be held liable for allergic reactions or adverse responses.
-
If you have a severe allergy, we recommend you do not consume our products.
SECTION 4 – ORDERS AND PAYMENT
-
All orders must be placed within the specified lead time shown on the website or agreed upon in writing.
-
Your order is confirmed only once full payment is received.
-
We may reject or cancel an order at our discretion (e.g., due to unavailable ingredients, limited capacity, or inappropriate requests).
-
Orders may not be cancelled or changed once confirmed, as all food is freshly prepared to order.
-
Prices are inclusive of VAT (where applicable) and do not include delivery fees unless otherwise stated.
-
Payment methods are processed securely through Shopify or another authorised provider.
SECTION 5 – DELIVERY AND COLLECTION
-
Delivery and collection times are arranged in advance and are estimates only.
-
We are not responsible for delays due to traffic, courier issues, or circumstances beyond our control.
-
Risk in the products passes to you upon collection or delivery to the agreed location.
-
Food should be stored and consumed within the recommended time frame provided on packaging or by Marta’s Kitchen. We accept no liability for products not stored correctly once delivered.
SECTION 6 – REFUNDS AND RETURNS
As our food is perishable and made to order, we do not offer refunds or exchanges unless the product is incorrect, damaged, or not as described.
If you believe there is an issue with your order, please contact us within 24 hours of delivery or collection at info@martaskitchen.co.uk with clear details and photos.
Refunds, if approved, will be processed at our discretion.
SECTION 7 – QUALITY AND AVAILABILITY
-
Ingredients are sourced fresh and may vary due to seasonality or supplier availability.
-
We reserve the right to substitute ingredients or components of a dish without notice, provided the overall quality and intent of the product are maintained.
-
Product photos are for illustrative purposes only.
SECTION 8 – CLIENT CONDUCT AND FAIR USE
We take pride in offering a professional, respectful service.
We ask that clients communicate courteously and reasonably with our team.
We reserve the right to decline future orders from clients who behave in a disrespectful, aggressive, or unreasonable manner, including persistent off-menu demands, late payments, or excessive change requests.
SECTION 9 – INTELLECTUAL PROPERTY
All content on martaskitchen.co.uk—including recipes, images, menus, brand name, logo, and materials—is the intellectual property of Marta’s Kitchen.
You may not reproduce, distribute, or use any part of our materials without written permission.
SECTION 10 – LIMITATION OF LIABILITY
To the fullest extent permitted by UK law:
-
Marta’s Kitchen is not liable for indirect, incidental, or consequential damages, including allergic reactions, illness due to improper food handling after delivery, or dissatisfaction with taste or presentation.
-
Our total liability for any claim shall not exceed the total amount paid for the relevant order.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence or fraud.
SECTION 11 – FORCE MAJEURE
We are not responsible for failure or delay in performance due to events beyond our control, including but not limited to extreme weather, strikes, illness, equipment failure, or supplier shortages.
